Who runs this

KODAMAP is made and run by Jiri Swen, one person in the Netherlands, as a personal project. It is not a company. You can reach me at jiri@nosk.be, and a person really does read it. These terms and your use of the site are governed by Dutch law.

Accepting these terms

Using KODAMAP means you accept these terms. If you do not, the honest answer is to stop using the site. The terms will change as the site grows: the date at the top of this page moves when they do, and if a change is significant and you have an account, I will email you about it before it takes effect.

Minimum age

You must be at least 16 years old to create an account or submit a tree.

Your account

Email and password only, no social sign-in. Keep your password to yourself: anything done through your account is treated as done by you. Give a real email address, because it is the only way you will hear what happened to a tree you submitted.

You can delete your account any time from settings, and export everything you have given the site as JSON from the same place. Deleting your account leaves the trees you added on the map with the attribution anonymised, unless you ask otherwise, because other people are relying on those trees existing. I can suspend or remove an account that is being used for spam, abuse, or to put dangerous or false information on the map.

What you submit, and the licence

You keep the copyright in your own photos and words. Nothing here takes that away from you.

Content licence

Tree data you submit is published under the Open Database License (ODbL). Photos you submit are published under CC BY-SA. By submitting a tree or a photo, guest or signed in, you grant KODAMAP and everyone else that licence to use it.

Read that twice, because it is the one thing on this page you cannot undo. Once something is published under an open licence, other people are allowed to copy and reuse it under that licence, and that permission does not stop if you later delete the tree, the photo, or your whole account. I can take your content off KODAMAP. I cannot take it back from anyone who already has it.

By submitting, you are telling me that the photo is yours to give, that you took it or have the right to license it, and that no one appears in it who has not agreed to be there. If that turns out not to be true, tell me and it comes down.

What not to submit

A tree on land you have no right to be on, or where you are claiming permission you do not have. A protected, ancient, or monumental tree where publishing its location would put it at risk. Someone else's photo. Anything that identifies a private home, a private garden, or a person who has not agreed to it. Deliberately false or dangerous information about a climb, which is the one on this list that could actually get someone hurt. And the ordinary rest of it: spam, advertising, abuse.

Moderation

Every submission is looked at by a person before it goes on the map. It can be published, sent back with a note about what needs fixing, or rejected. You get an email either way. There is no automated decision-making involved: it is me, reading it.

A submission that has been sent back and left alone is deleted after 90 days, along with its photos, and you get a reminder a week before that happens. Rejected submissions go on the same schedule. Rejecting or removing something is my call, and if you think I got it wrong, reply to the email and I will look again.

Climbing is at your own risk

Climbing a tree is dangerous. Branches break, bark gives way, and a fall from head height can kill you. The effort and joy ratings on KODAMAP are other people's opinions, not a safety inspection. No one from KODAMAP has tested any tree listed here for structural soundness, and no one can know its condition today. If you climb a tree found through this site, you do so entirely at your own risk. Check the tree yourself before you trust it with your weight. Don't climb with children unsupervised. KODAMAP, its creator, and its contributors accept no liability for injury, death, or property damage arising from climbing a tree listed on this site.

Everything on the map is submitted by other people and is not verified beyond a look at whether it seems real. A tree changes. It loses limbs, it rots from the inside where you cannot see, it gets felled. The description you are reading may be years old and may have been wrong when it was written.

The site is provided as it is, with no warranty of any kind, and I do not promise the information on it is accurate, current, or complete. To the fullest extent Dutch law allows, I am not liable for any loss or damage arising from your use of the site. Dutch law does not allow that exclusion to cover everything, and I am not trying to pretend otherwise: liability for death or personal injury caused by my negligence, and liability for my own intent or gross negligence, cannot be excluded and are not excluded here.

Land and access

A tree appearing on this map is not permission to go and stand under it. Access rules differ by country, by region, and often by field, and it is on you to know what applies where you are. Where a submitter has said a tree is on private land, the map says so, and "permission" there means the permission they told me they had, not any permission that extends to you.

The site itself

This is a hobby project maintained on evenings. It can be slow, it can be down, features can change or disappear, and one day it may stop entirely. There is no uptime promise and no guarantee that anything is kept for any length of time beyond what the privacy page says. If it is ever going to shut down, I will say so first and give you time to export your data.

Other people's work

The basemap is built from OpenStreetMap data, made available as vector tiles by Protomaps, and is © OpenStreetMap contributors under ODbL. The site, its database, and its photos are hosted on Cloudflare, and account email is sent through Resend. Those are all of them. The privacy page has the detail on what each one sees.

These terms have not been reviewed by a lawyer. They are written honestly and carefully, and they will get a proper legal read once the site has meaningful traffic.
